One of the term to be fulfill towards as a licensed land surveyor in peninsular Malaysia is to pass laws and regulations. I just sat for the paper on 23 May 2007. Below are the 9 questions to be anwered within 3 hours. This paper required to speed and the knowledge in National Land Code 1956 and others related laws regarding lands. Please kindly go through the questions and reply to me if you need the answer. Thank you.
Question 1
The Land Surveyors Board registers licensed land surveyors, articled pupils (AP) and field assistants (FA). A licensed land surveyor is governed by the Licensed Land Surveyor Act 1958 and is subjected to disciplinary action punishable under section 17 of the Act if he commits any professional misconduct.
a) Discuss whether displinary action for professional misconduct can be taken against a licensd land surveyor based on wrong doing commited by his AP or FA.
b) What action can be taken by the Land Surveyors Board against the above AP or FA?
c) What effect on the above pratice, FA and AP if the licensed land surveyor has his license suspended?
Question 2
Based on the amendment of National land Code in 2001, final title may be issued in lieu of qualified titleif it is just and expedient,.There is now a proposal to totally abolish the issuance of qualified title. Taking cognizance of current development, discuss:
a) The impact of the proposal on the relevant provisions in the National Land Code 1965.
b) The impact of the proposal on relevant provisions in the Licensed Land Surveyors Regulations 1959 and Peraturan Ukur Kadaster 2002.
c) The impact of the proposal on a licensed land surveyor and the public in general.
Question 3
Land boundaries are defined by bearing and distances as shown in the certified plan. They are further demarcated on the surface of the ground by boundary marks. These boundary marks should be refixed if there is evidence that they have moved. This can be easily done if the suvey was previously carried outto first or second standard. However there are lands not surveyed to the above standards.
Discuss the procedure to refix boundary marks which were previously not surveyed to first or second class standard.
Question 4
In planned alienation of State Land fees due according to Form %A of the National Land Code 1965 (NLC)include payment of survey fees. Normally land owners would pay survey fees at different times. The LandAdministrotor is therefore unable to prepare the requisitions for survey (RS) for all lots according to Section 181 (ca) of the NLC at the same time for such planned alienation. Hence the RS are prepared and sent to State Department of Survey and Mapping in stages. Some land owners who urgently need te final titles will engage Licensed Land Surveyors to survey their land. Under this circumstance survey from part to wholeis therefore unavoidable.
a) Discuss issues in surveying land under this circimstance.
b) If a licensed land surveyor is to be engaged, suggest the best approach the land so that it will not cause problem for subsequent surveys of the remaining surrounding lots.
Question 5
In the large subdivision of land, certain land parcels are surrendered to the State Authority for purposes such as road reserve, open space, school, TNB substation and et cetera as condition of approval.State Department of survey and Mapping requires the lands to be issued with lot numbers and surveyedif they form close polygons
a) What action must be taken by the authorities to ensure that the lands are to be used for the designatedpurposes?
b) What are the implications of issuing lot numbers and surveying such land parcels?
Question 6
You are appointed to prepared strata titles application for scheme developement for mixed development consisiting of residential and commercial units. After computing the share unit for each parcel, you refer the list to developer for his endorsement.
a) Explain how the share units are computed and how many methods could be employed.
b) Explain the purposes of allocating share units to each parcel and recommend and justify which is suitable for the scheme.
Question 7
You are preparing a sub-division pre-computation plan of a lot of one hundred hectares of 4,000 metres perimeter. The magnitude of the misclose is one meter giving a linear misclose of 1 : 4000. The lot is surrounded by housing schemes.
a) Discuss the possible causes of the misclose and its effect on the size and design of the proposedunits in the pre-computation plan.
b) How do youovercome the problem so that it will not affect lot size, width of road reserve and itsalignment with surrounding lots and road reserved?
Question 8
A land owner wishing to appoint a new licensed land surveyor to replace the existing one can do so after the service of the former has been properly terminated. Normally the terminated licensed landsurveyor will make statement claim due to him
a) In this situaton discuss the rights of the first licensed land surveyor, the newly appointed licensedland surveyor and land owner.
b) What are the items that the first licensed land surveyor can include i his statement of claim and discuss what are the basis of the claim.
Question 9
The National Land Code 1965 (NLC) provides for the disposal of underground land known as stratum.
a) Stratum titles can be issued under three circumstances. State and describe briefly these circumstances asprovided in the NLC 1965.
b) Director General of Survey and Mapping Circular number 5 of 1999 and 2 of 2006 relate to stratum plan.i) What are the purposes of the two circulars?ii) Describe the surveys required for the preparation of stratum plan and certified stratum plan.

A housing developer owns two pieces of land held under registry title separated by a road reserve. Both lands are under the category of buildings. He intends to build two blocks of twenty storey buildings and applies strata titles for each unit in both blocks. Since both blocks belong to him and the road reserve lead to a dead end he intends to fence both blocks including the road reserve. Considering the relevant provisions in the Strata Tiles Act 1985 and National Land Code 1965 discuss whether he is allowed to do that.
this is my lecturer question. i just couldnt figure out which provision to use in the NLC. legally i think the owner could not fence the land..
